OutreachGenius Terms of Use

1. Use of Service

These Terms of Use (the “Terms”) govern access to and use of OutreachGenius websites, applications, communications features, automations, and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Accounts

You are responsible for account credentials and for all activity under your account. You agree to provide accurate information, keep it updated, and promptly notify us of unauthorized use or security concerns.

3. Acceptable Use

You may not use the Service to:

• Break laws or violate third-party rights.
• Send harmful, deceptive, abusive, or fraudulent communications.
• Attempt to disrupt, disable, reverse engineer, or gain unauthorized access to the Service.
• Upload malware or content that interferes with platform integrity.

4. Fees and Payments

Paid features require payment of applicable fees as shown in an order, checkout flow, or subscription plan. Unless stated otherwise, fees are billed in advance, non-refundable except where required by law, and may be suspended for non-payment after reasonable notice.

5. Intellectual Property

OutreachGenius and its licensors retain all rights, title, and interest in the Service, including software, branding, and documentation. You retain rights to content you provide. You grant OutreachGenius a limited license to process your content solely to provide and improve the Service for your account.

6. Privacy and Confidentiality

Our handling of personal data is described in our Privacy Policy. Each party agrees to protect non-public confidential information received from the other party and use it only for legitimate business purposes related to these Terms.

7. Third-Party Services

The Service may integrate with third-party tools, telephony providers, and data sources. We are not responsible for third-party products or their terms, availability, or policies.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, OutreachGenius disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, OutreachGenius will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, or data. Total liability for claims arising out of or related to the Service is limited to amounts paid by you to OutreachGenius for the Service in the 12 months before the event giving rise to the claim.

10. Termination

You may stop using the Service at any time. OutreachGenius may suspend or terminate access for violations of these Terms, security risks, non-payment, or legal reasons. Upon termination, your right to use the Service ends immediately.

11. Governing Law

These Terms are governed by applicable laws determined by the parties’ agreement or, if not specified, by the laws that apply where the Service is provided, without regard to conflict-of-law principles.

12. Changes to Terms

We may update these Terms periodically. Updated Terms become effective when posted, unless a later date is stated. Continued use of the Service after the effective date means you accept the revised Terms.
